Floqu Terms of Service

When you use Floqu or any related services, you agree to these Terms of Service.

When you use Floqu or any related services, you agree to these Terms of Service (“Terms”). Violation of these Terms may, at our discretion, result in suspension or termination of your account.

We may update these Terms at any time. If we make significant changes, we’ll refresh the date above and, where practical, notify users by email or via our website.

1. Definitions

“Floqu”, “we,” “our,” or “us” means Locase Pty Ltd (ABN [insert ABN]) trading as Floqu, headquartered in Victoria, Australia.

“Services” means any websites, applications, or products operated by Floqu, including floqu.com and app.floqu.com, whether accessed via web browser, desktop, or mobile.

“You” or “your” means the individual or organisation that owns or controls an account on the Services.

2. Account terms

  • You are responsible for maintaining the security of your account credentials and ensuring that anyone with access does the same. Floqu is not liable for loss or damage resulting from failure to secure your account.
  • You are responsible for all activity that occurs under your account.
  • Accounts must be registered and used by real people — not bots or automated systems.
  • We may require two-factor authentication for added security.

3. Payments, refunds, and plan changes

  • Free plans are truly free: we will not request payment details or sell your data.
  • Paid plans require payment in advance after any applicable free-trial period. Unpaid accounts may be frozen and eventually cancelled.
  • Upgrading from free to paid starts a new billing cycle on the date of upgrade.
  • Plan changes take effect from the next billing cycle.
  • All prices are in Australian dollars (AUD) and exclude GST unless stated otherwise.
  • We process refunds according to our [Refund Policy] (link to page).

4. Cancellation and termination

  • You may cancel your account at any time using the steps in our [Cancellation Policy]. Email or phone requests do not automatically cancel an account.
  • Once cancelled, your data becomes inaccessible. Within 30 days, it is permanently deleted from active systems and within 60 days from backups.
  • Cancellations take effect immediately; no prorated refunds are offered for partial billing periods.
  • We may suspend or terminate accounts at any time if:
    • you breach these Terms,
    • we detect misuse or abuse, or
    • we discontinue the Service.
  • Abuse or threats toward Floqu staff will result in immediate termination.

5. Service changes and pricing

  • We may modify, suspend, or discontinue features or pricing at any time.
  • Existing customers will receive at least 30 days’ notice of any pricing changes.
  • Notices may be sent via email or displayed within the app.

6. Uptime, security, and privacy

  • Floqu provides Services on an “as is” and “as available” basis.
  • We take uptime seriously and maintain backups, redundancy, and encryption for data in transit and at rest.
  • We may temporarily disable accounts that place disproportionate load on our systems.
  • By using Floqu, you consent to our handling of your data as described in the [Privacy Policy].
  • Our team may access limited data only when necessary to:
    • resolve support requests,
    • investigate bugs or abuse, or
    • comply with Australian law.
  • Floqu’s primary data infrastructure and subprocessors are listed in our [Data Processing and Subprocessors page].
  • Floqu complies with the Australian Privacy Principles (Privacy Act 1988 (Cth)) and, where applicable, the GDPR and UK GDPR.

7. Copyright and content ownership

  • You retain ownership of all content you upload or create within Floqu.
  • By using the Service, you grant us a limited licence to store and process that content to operate the Service.
  • Floqu reserves the right (but not the obligation) to remove content that violates laws or these Terms.
  • Floqu and its licensors own all intellectual-property rights in the Services, including design, code, and branding.
  • You may not copy, reproduce, or exploit any part of the Services without our written permission. Requests for permission to use the Floqu name or logos may be sent to hello@floqu.com.

8. Limitation of liability

To the fullest extent permitted by law:

  • Floqu and Locase Pty Ltd are not liable for indirect, incidental, special, or consequential damages arising from your use or inability to use the Services.
  • Our total liability for any claim is limited to the amount paid by you to Floqu in the previous 12 months.
  • Nothing in these Terms excludes liability that cannot be excluded under Australian consumer law.

9. Governing law

These Terms are governed by the laws of Victoria, Australia. You agree that any disputes will be resolved exclusively in the courts of Victoria.
